Mobile Phone and Handheld Device Rules for HGV Drivers in the UK

HGV cab with phone mounted hands-free for legal use
Summary
Holding a phone to use it while driving is illegal. That includes scrolling, unlocking, filming and many ‘just two seconds’ habits — even in slow traffic with the engine on.

The core rule

In the UK it is illegal to hold and use a phone, tablet or similar device while driving. “Using” is wider than making a call — it includes illuminating the screen, checking messages, scrolling, taking photos/video and similar interaction while you are in control of the vehicle.

This article covers that handheld device rule for drivers. It is not a full in-cab technology policy for every fleet app.

When you are “driving”

You can still be treated as driving when the vehicle is stationary but you remain in control — for example waiting at lights or in traffic with the engine running. Pulling into a safe place, stopping properly, and then using the phone is the lawful pattern when you need the handset.

Hands-free is not “do anything”

A mounted phone used without holding it may be lawful for certain functions, but distraction remains a real risk and other offences (careless/dangerous driving) still apply if your attention leaves the road. Company rules may be stricter than the criminal baseline — follow the tighter rule.

Common excuses that fail

  • “I was only moving the satnav pin”
  • “Traffic was stopped”
  • “It was on speaker so holding it was fine”
  • “I needed the warehouse photo for proof of delivery mid-junction”

Penalties context

Handheld phone use while driving attracts fixed penalties and points (and can escalate). For professional drivers, licence points are a career risk, not a minor inconvenience.

Driver habit

Mount the device before you move. If you must type, call or photograph: safe stop first. No load or planner message is worth a ban.
