When Drivers’ Hours Rules Do Not Apply: Common Exemptions Overview

A high-level map of the idea that some operations sit outside (or partly outside) the main assimilated drivers’ hours and tachograph framework used for many HGV duties. It is not a full exemption catalogue and not authority to self-exempt.
Why exemptions confuse drivers
People hear “short distance”, “own account”, “special vehicle” or “emergency” and assume the tachograph can be ignored. Most of those phrases have strict legal tests. Guessing wrong is still an infringement.
Driver-safe mindset
- Your operator / planner decides which rulebook today’s work sits under
- If the vehicle is in-scope for tachograph work today, record properly
- If today’s work is genuinely exempt under a confirmed procedure, follow the recording method that procedure uses (including domestic records where required)
- Never invent Out of Scope to hide tiredness or late loading
Examples of themes (not a yes-list)
UK guidance discusses categories such as certain specialised vehicles, tightly defined local operations, and other limited cases. Each has conditions. The existence of a category in guidance does not mean your Friday run qualifies.
Mixed weeks

Driver habit
Before you change mode or skip the card, ask: “Which written rulebook is this duty under?” If nobody can answer in one sentence, assume full recording until told otherwise by someone accountable.
